Electronic Communications Agreement

This Electronic Communications Agreement (this “Agreement”) is between Modu Technologies LLP (“Modu,” “we,” “us,” or “our”), together with any banking or payment partner acting through us, and you, the individual or legal entity using the Modu services (“you” or “your”). If you are accepting this Agreement on behalf of an organization, you represent that you are authorized to bind that organization.

We (or a banking or payment partner acting through us) will deliver Communications to you electronically — through the Modu website, the Modu web application, by text or SMS message, or by email. If we cannot deliver a Communication in one of these ways, we will tell you where you can go to receive it.

We or a partner may still be required by law to deliver certain Communications to you on paper, even though you have consented to electronic delivery.

To receive and retain electronic Communications, you will need:

  • a computer or mobile device with a supported operating system;
  • an internet connection;
  • a current version of a supported web browser (a recent version of Chrome, Firefox, Safari, or Edge);
  • a way to store data (for example, a hard drive or cloud storage);
  • a valid, active email address; and
  • software that can display PDF files.

We may update these requirements from time to time to maintain our ability to provide electronic Communications. If a change is substantial, we will notify you. By confirming your consent, you acknowledge that you are able to access and retain electronic Communications, including PDF documents.

It is your responsibility to keep your email address and other contact information current so that you can receive Communications without interruption. We are not responsible if you do not receive a Communication because your information is outdated or incorrect. You can update your contact information in your Modu account settings, or by emailing support@modu.kz.

You may request a paper copy of any electronic Communication at any time by emailing support@modu.kz. You may also obtain a paper copy by printing the Communication yourself. We do not charge a fee for a reasonable number of paper copies.

We are required by law to provide certain information to you in writing. All Communications we deliver to you in either electronic or paper form are considered to be “in writing.” You should print or save a copy of any Communication that is important to you.

You may withdraw your consent to receive Communications electronically at any time by emailing support@modu.kz. If you withdraw consent, we may not be able to continue providing account services and will help you close your account and receive any remaining funds and required disclosures on paper. Your electronic signature and your consent to electronic Communications have the same legal effect as a handwritten signature and paper records under the Law of the Republic of Kazakhstan “On Electronic Document and Electronic Digital Signature.”
